Terms of Use

Effective date: [EFFECTIVE DATE] Last updated: [LAST UPDATED DATE]

These Terms of Use govern access to the MatchHomes website and platform, including property portfolios, client profiles, matching features, AI assistance, and Home Collections. They form an agreement between you and [LEGAL ENTITY NAME], trading as MatchHomes, at [REGISTERED ADDRESS] ("MatchHomes," "we," "us," or "our").

Please read these terms before using the service. By accepting them through the relevant registration or access process, you agree to follow them. If you act for a brokerage or another organization, you must have authority to bind that organization.

Our Privacy Policy explains how personal information is handled. Our Cookie Policy explains cookies and related choices.

1. What MatchHomes provides

MatchHomes provides tools that help real estate professionals organize properties, understand client priorities, compare properties against those priorities, and share personalized Home Collections. Clients can review their search profiles and submit feedback through the features made available to them.

The service supports research and collaboration. A property match, score, explanation, or collection is an informational output. It does not guarantee that a home is available, suitable, affordable, legally compliant, or obtainable on particular terms.

Unless a separate written agreement expressly says otherwise, using MatchHomes does not appoint MatchHomes as your real estate representative, lender, appraiser, surveyor, or legal adviser. Any agency relationship, listing agreement, offer, financing arrangement, or property transaction is established separately with the relevant parties.

2. Eligibility and account access

You must be at least 18 and legally able to enter into this agreement to use the service. Organizations are responsible for authorizing the people who access their accounts.

Provide accurate account information and keep it current. Protect your credentials, use only accounts you are authorized to access, and notify [SUPPORT EMAIL] if you suspect unauthorized use. Do not share individual login credentials or bypass account or subscription limits.

Some client features may be available through an invitation or shared link. Accessing a collection does not authorize access to an agent's wider portfolio, other client profiles, or restricted account areas.

3. Professional and client responsibilities

Agents and brokerages remain responsible for their professional services, licensing obligations, communications, listing accuracy, and compliance with applicable real estate and privacy laws.

If you create a client profile, import contact details, upload a listing, or send an invitation, you must have the rights and lawful authority needed for that activity. Provide required notices and obtain permissions where necessary. Do not assume that having access to information gives you permission to upload or share it.

Clients should review the information presented for confirmation and tell their agent about inaccuracies or changing priorities. Confirming a search profile does not make an offer, establish financing eligibility, or commit anyone to a property transaction.

4. Permitted use and prohibited conduct

You may use MatchHomes for its intended functions within your authorized access and any applicable subscription or customer agreement.

You must not:

  • Submit misleading listings, impersonate someone, or misrepresent your authority to act for a client or property owner.
  • Upload content or personal information you do not have the right to provide.
  • Use the service for unlawful housing discrimination, exclusion, steering, harassment, or other unlawful treatment.
  • Use matching results as a substitute for a lawful credit, mortgage, background-check, or tenant-screening process.
  • Scrape, harvest, resell, or redistribute platform data without authorization, or remove required attribution or notices.
  • Bypass access controls, probe restricted accounts, introduce malicious code, or interfere with service availability.
  • Reverse engineer protected software except where applicable law gives you a right that cannot be restricted.
  • Send unlawful bulk messages or use client information for purposes outside your authority.

5. Property information, maps, and external data

Information can come from agents, brokerages, listing feeds, property records, map services, and other sources. Those sources may have different update schedules, licensing restrictions, and levels of accuracy.

Verify material details before making a decision. This includes price, availability, measurements, ownership, permits, property condition, school assignment, travel times, and other location information. A map, route, boundary depiction, or distance estimate is not a survey or a guarantee of real-world conditions.

Do not remove provider attribution or use imported information beyond the rights granted by its source. An MLS import or integration is available only where enabled and properly authorized; these terms do not grant rights in an external provider's database.

6. Matching and AI-generated information

Matching uses the available property information and the priorities associated with a client profile. Results depend on the information supplied, the properties considered, and the relevant processing method. A high score does not mean a home meets every need; a low score does not establish that it is unsuitable.

AI-assisted features can help organize submitted information or prepare suggestions and explanations. Generated content may contain errors, unsupported assumptions, or omissions. Review important outputs, verify facts, and correct profile details before relying on them or sharing them with a client.

Agents remain responsible for the homes they propose and the advice they give. Clients remain responsible for their own decisions with appropriate professional support. Do not use the service to make unlawful decisions or represent a generated explanation as an independently verified fact.

The Privacy Policy describes how information is processed through matching and AI features, including the applicable provider and training disclosures. Accepting these terms does not replace any separate consent required for optional data uses.

7. Your content and the rights needed to operate the service

As between you and MatchHomes, you retain the rights you hold in content you submit. This can include listing descriptions, photos, client details, messages, and other material. You are responsible for ensuring you can lawfully provide it.

You authorize MatchHomes and the providers involved in delivering the service to process, store, reproduce, format, and display that content as needed to provide the requested features, maintain service security, and follow your authorized sharing instructions. This permission is limited to those purposes and the applicable agreement; it does not transfer ownership of your content to us.

Personal information remains subject to privacy law, our Privacy Policy, and applicable data processing terms. This content permission is not an unrestricted license to sell personal information or train AI models. Rights in generated material are subject to applicable law, third-party rights, and any separately disclosed service terms. Outputs may be similar to material generated for others and are not guaranteed to be exclusive or protectable.

8. Home Collections and sharing

Share collections only with people you are authorized to include. Check the recipient and the information shown before sending a link, particularly when a collection contains client priorities or personal destinations.

Access depends on the sharing method actually used. A forwarded link may allow additional people to view information if the access rules permit it. Do not bypass recipient restrictions or redistribute a collection beyond the permissions granted to you.

Likes, dislikes, and tour requests communicate interest or feedback. They do not reserve a property, confirm an appointment, constitute an offer, or create a contract to buy or rent. Confirm next steps directly with the agent.

9. Fees, subscriptions, and cancellation

If you purchase a paid service, the applicable order or checkout must state its price, billing frequency, taxes, included access, renewal terms, cancellation method, and refund conditions before purchase. A separate customer agreement may govern business subscriptions.

[INSERT ACTUAL BILLING, AUTOMATIC RENEWAL, CANCELLATION, AND REFUND TERMS, INCLUDING ANY REQUIRED CONSUMER WITHDRAWAL RIGHTS. REMOVE THIS SECTION IF NO PAID SERVICE IS OFFERED.]

Changes to paid plans will be handled under the applicable agreement and required notice rules. These terms do not remove refund, cancellation, or other rights that the law makes mandatory.

10. Third-party services

The service can link to or integrate with external listing, map, communication, and other tools. Their separate terms and privacy notices apply to their own services. You are responsible for the permissions needed to connect an account or supply data through an integration.

External content and service availability can change. A link does not, by itself, mean MatchHomes endorses the external service or guarantees its information.

11. MatchHomes intellectual property

The platform software, branding, and materials created by MatchHomes are owned by us or our licensors. Your access grants permission to use the service as described in these terms; it does not transfer ownership or grant a right to reproduce our branding, software, or proprietary databases outside that use.

Client content and third-party listing or map materials remain subject to their respective rights.

12. Service changes, suspension, and account closure

We may update features or restrict access when reasonably necessary to address security threats, unlawful activity, material breaches, or legal requirements. Where appropriate, we will explain the restriction and provide an opportunity to address it. Immediate action may be necessary where notice would create a risk or is prohibited.

To request account closure, contact [SUPPORT EMAIL] or use [ACTUAL ACCOUNT CLOSURE METHOD]. Closing an account, canceling a subscription, and requesting deletion of personal information are separate actions and can have different consequences.

Contractual export arrangements and the Privacy Policy govern the handling of information after access ends. [INSERT ANY ACTUAL EXPORT WINDOW AND POST-TERMINATION ACCESS TERMS.] Provisions that are intended to continue, including ownership, payment obligations already incurred, and applicable dispute provisions, survive termination to the extent lawful.

13. Service assurances and limitations

Subject to any express commitments in a separate agreement and rights that cannot lawfully be excluded, the service is provided on an available basis without a promise of uninterrupted operation or error-free information. We do not guarantee a particular match, transaction, financial outcome, or business result.

Nothing in these terms excludes mandatory consumer protections or responsibilities that applicable law does not allow us to exclude.

14. Liability

Any limitation must be read subject to mandatory law and the circumstances in which liability cannot be limited. These terms do not exclude liability for fraud, deliberate misconduct, or any other liability that cannot lawfully be excluded or restricted.

[INSERT LEGALLY APPROVED LIABILITY PROVISIONS, INCLUDING ANY MONETARY CAP, THE LOSSES IT COVERS, AND REQUIRED EXCEPTIONS. IF PROFESSIONAL-CUSTOMER INDEMNITIES ARE USED, DEFINE THEIR SCOPE AND DEFENSE PROCESS HERE WITHOUT APPLYING THEM INDISCRIMINATELY TO CONSUMERS.]

15. Governing law and disputes

Please contact [LEGAL CONTACT EMAIL] first if you have a concern so we can try to resolve it.

These terms are governed by [APPLICABLE GOVERNING LAW], and disputes are subject to [APPROVED COURTS OR DISPUTE PROCESS]. Any mandatory rights to bring a claim in your local courts or benefit from the laws protecting you as a consumer remain unaffected.

16. Updates and other terms

We will identify the effective date of updated terms and provide any notice or renewed acceptance required by law or the applicable agreement. Changes do not retrospectively remove rights that have already accrued.

If you have a separate signed customer agreement, its express terms prevail where it conflicts with these terms for the services it covers. Applicable data processing terms govern the processing activities they cover. A provision found unenforceable will be limited or removed only to the extent necessary; the remaining provisions continue where lawful.
